Please read these terms carefully before using our services

1. Definitions

In these Terms of Service:

• "Service" refers to the Evidence Custodian platform operated by GNU IT Solutions & Services Pvt. Ltd.
• "User," "You," "Your" refers to any individual or entity using the Service.
• "We," "Us," "Our" refers to GNU IT Solutions & Services Pvt. Ltd.
• "Certificate" refers to the Section 63 BSA compliant digital evidence certificates generated by the Service.
• "Evidence" refers to digital files uploaded to the Service for certification.

2. Acceptance of Terms

By registering for, accessing, or using Evidence Custodian, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and GNU IT Solutions & Services Pvt. Ltd.

We reserve the right to modify these terms at any time. Continued use of the Service after modifications constitutes acceptance of the updated terms.

3. Description of Service

Evidence Custodian provides:

• Generation of Section 63 BSA (Bharatiya Sakshya Adhiniyam, 2023) compliant certificates for digital evidence
• Cryptographic hash calculation (SHA-256) for file integrity verification
• Blockchain timestamping for immutable proof of existence
• Metadata extraction from digital files including EXIF and GPS data
• Secure storage and chain of custody tracking
• Multiple certificate format outputs (PDF, DOCX, HTML, JSON)

4. User Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Be a legal professional, law enforcement officer, corporate entity, or individual with legitimate need for digital evidence certification
• Provide accurate and complete registration information
• Maintain the security of your account credentials

5. User Responsibilities

5.1 Lawful Use

You agree to use the Service only for lawful purposes and in accordance with applicable Indian laws, including but not limited to:

• Bharatiya Sakshya Adhiniyam, 2023 (Indian Evidence Act)
• Information Technology Act, 2000 and IT Rules
• Bharatiya Nyaya Sanhita, 2023
• Bharatiya Nagarik Suraksha Sanhita, 2023

5.2 Prohibited Uses

You shall not:

• Upload illegal, obscene, defamatory, or harmful content
• Use the Service to fabricate, forge, or manipulate evidence
• Attempt to deceive courts or legal authorities using certificates generated by the Service
• Share your account credentials with unauthorized parties
• Attempt to reverse engineer, hack, or compromise the Service
• Use automated systems to access the Service without permission
• Violate any applicable laws or regulations

5.3 Accuracy of Information

You are solely responsible for the accuracy and authenticity of files uploaded to the Service. The Service certifies the digital properties (hash, metadata, timestamp) of files but does not verify the truthfulness or legal validity of the content.

6. Intellectual Property

6.1 Our Rights

All intellectual property rights in the Service, including software, design, logos, and documentation, are owned by GNU IT Solutions & Services Pvt. Ltd. or its licensors.

6.2 Your Rights

You retain all rights to the evidence files you upload. By using the Service, you grant us a limited license to process your files for the purpose of generating certificates.

7. Payments and Refunds

Payment terms and refund policies are governed by our separate Refund Policy. Key points include:

• All prices are in Indian Rupees (INR) and inclusive of GST
• Credits purchased are valid for the specified period
• Refunds are processed as per our Refund Policy

8. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you for the Service in the preceding 12 months
• We are not responsible for decisions made by courts or legal authorities regarding certificate admissibility
• We do not warrant uninterrupted or error-free service

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will meet your specific requirements
• Warranties that certificates will be accepted by all courts or authorities

10. Indemnification

You agree to indemnify and hold harmless GNU IT Solutions & Services Pvt. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload to the Service

11. Data Security

We implement industry-standard security measures to protect your data. However, no method of electronic storage is 100% secure. Please refer to our Privacy Policy for details on data handling.

12. Termination

We may suspend or terminate your access to the Service:

• If you violate these Terms
• If we suspect fraudulent or illegal activity
• If required by law enforcement or court order
• At our discretion with reasonable notice

Upon termination, your right to use the Service ceases immediately. Previously generated certificates remain valid as records of the certification performed.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

14. Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through:

1. Direct negotiation between parties
2. Mediation by a mutually agreed mediator
3. Arbitration under the Arbitration and Conciliation Act, 1996

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and GNU IT Solutions & Services Pvt. Ltd. regarding the Service.
